Ch. VI. Judicial Damage-preventative Applications

§.4. Applicants who and for what in respect of interest.

§§. Proxies receivable who Ch.
Of damage preventative applications by unauthorized uncommissioned proxies.

Art. On hearing any person appearing as above
as proxy for another the Judge will immediately ascertain
whether the application be contentious or uncontentious
and in either case whether on a further hearing the attendance
of the principal shall be required or may be dispensed excused
with.

Art. 1 When a person an applicant [+] [+] having an interest
in the subject matter be of
his application
attends and makes application on the behalf of
a person or person other than himself and who is are not present likewise
such person or persons either have the same interest concern
in the matter as he himself has or not they have not — if
they have, he and their be in the aggregate
denominated by the common appellation of
commissioner

were he and they either have some common interest in the matter
or they have not: if yes, he and they are cointerestees

Art.2 Of the cases in which such conjunction of interests
may have place examples are

Art 3. In behalf of any person or persons an
application made be made either without or with authority
from the person or persons on whose behalf it
was made is made

Art. 4 If it be without authority, a self constituted
proxy
is the appellation by which in this case the applicant is denominated

Art In this case then it will be among the
cares of the Judge without sufficient security at the charge of the applicant not to take any step from which
damage to any other person may be likely to ensue

Art. 5. A self constituted benevolent proxy is the appellation
by which he will be designated, if in so far in his opinion
the desire of serving the interest of the party on whose
behalf the application is made constituted to which is
the main part of the instrument by which the application was produced.
