II. If this suit be a purely penal suit the following
are the characters in any one of which the applicant may
present himself.

1. A person giving information An informant by whose information it appears of the an alledged offence,
criminal act as having been committed in his presence present to his senses, with or
without a designation of the offending any individual or individuals
as being partaking in the act concerned in the evil in the character
of offender or offenders.

2. A person giving information of An informant by whose information it appears an alledged criminal,

which having been present to his senses, has operated on
his mind as affording circumstantial evidence of some
criminal forbidden act, with or without a designation of an individual
or individuals in the character of offender or offenders
