§. Defence, how procurable.
I For Pursuer's benefit
1 Statement elicitation
2 Testification
3 Compliance
Art. 1 Distinguishable Purpose for which, between the Judge and
a Defendant, intercourse is necessary are the following:
I. For the benefit of the Pursuer, if in so far as he is in the right.
1. Statement — elicitation of the defendants statement, included admission statement
2. Testification — elicitation of the Defendant's confessional testimony
3. Compliance or execution — reddition of the judicial service
due, as per Pursuers demand to wit either by compliance
and performance of the effective service, or by execution.
The Judge thus rendering it instead of and at the charge of
the Defendant.
II. For the defendants benefit
1. Statement elicitation
2 Testification
3 Compensation required —
elicitation
II. For the benefit of the Defendant. in so far as he
is in the right.
1. Statement — elicitation of the Defendant's requisitive statement.
2. Testification — elicitation of the defendants self serving testimony.
3. Compensation — elicitation of the Defendant's demand
for compensation, at the Pursuer's charge, for expence
and vexation produced to the defendant by the Suit.
