(2 §.4. Defence how elicited
V. Information giveable
Art. 4. If the design of the Judge be that whether
for the purpose of contestation or testification or both his mode of communication
with the Judge and with or without the adverse party or parties
on the other adverse side be the oral mode, the instrument of communication
will be an Attendance-requiring Mandate
For the form thereof see the Formularies. §§.
Art. 5. This Attendance-requiring Mandate will
be either an Attendance and contestation requiring Mandate
or Attendance and testification-requiring Mandate or both
in one.
For the forms in both cases see as above Ch. Formularies.
Art., 6. In either case it will convey information and
requisition under the heads following
1. Place at which the attendance is to be paid — principal the Attendance
requiring Judicatory, or some Co judicatory as the case may require
2. If the Attendance requiring Judicatory's Justice Chamber, or should that be engaged some subsidiary
Justice Chamber as the case may be.
3. Time fixt for attendance, time as designated by the Year,
Month, day of the month and day of the week and hour.
4. Particulars of the demand on the pursuer's side, as expressed
in the Pursuer's Demand paper, as per Ch. VIII. §.
5. [Exceptions, if any, excepted,] an exemplar of the record, in
design as it was produced: including the evidence: such evidence if any as has been elicited [the evidence
on the grounds of which he has been called for upon either to render
the service demanded or to contest the pursuer's right to cause
it to be rendered.]
