VI Defendant's Responses — instrument
to be required
(1)
Art. When a day is thus fixt for the Defendants attendance
at the Judicatory, required by the mandate in the mean
time, if the time admitt will be
1. An instrument of response A defendant's response paper promising attendance on the day
prescribed, or making excuse as to that day and offering attendance
on another day therein mentioned
2. A Defence paper in a form correspondent to that of the
Demand paper

Art. Evidence self-serving or self-differing or both
together to be delivered in the epistolary mode will at the same
time be called for, or not, as to the Judge may seem most
conducive to the ends of justice.

Art. Of the matters thereupon received from the Defendant,
communication will thereupon be made by the Judge if time admitt to the
Pursuer or Pursuers that be they in the mutual hearing,
he or they may be the better prepared.
