Effect of the distinction
So much for the origin. As to the effect — the law
of distinction is that below the trav what is tranquil and what is
continuous; a distinction in the political nosology analogous
to that between acute and terminal in the natural nosology

In a case of which the Common Law predicates take cognizance
there is but one demand either altogether simple or in but comparatively a slight
degree complex, in or in one of where the judicature called
Equity Courts take cognizance, the subject matter of demand
is to an indifferent degree complex: the Common Law mode of procedure
did not in its origin comprize, does not at this time comprize
powers adequate to the affording satisfaction to the demand
Example account
suits
The case of account may serve for example. An account cause
is really that class of service which running out at length and
composed of a multitude of Suits. Executed together in one bylaw
is capable of being by appropriate section made to produce as
many distant variants of the same species as the true values rings liable
for so many in every account as this or those in of so many separate suits may they
be constituted subject matters.
