3. Means of communication: of person needful with person, needful
and of person needful with things needful. Be the demand what it may
be the particular mode of execution be the facts of the case what they may what it may — be the evidence appropriate and form of the evidence
needful and to mode of obtaining the ser eliciting it from the source what they may, the
means of but adopted to the purpose of effecting the necessary communication
necessary like the person and things in question can not in any
case be different. Only as to the question will it in the penal
case be for the purpose of obtaining the evidence be worth while to employ
the means of communication necessary to that purpose, here
too the in this case as in the former the balance may in some
cases require to be taken in hand, and against the good expected from
employing the necessary means of communication weighed against
the evil inseparable from the employing them.
