Judges fixation will be
generally lower than pursuers.
But Judge may
see grounds for higher
fixation if so he will
point them out to pursuer
Instrumental.
Art. 18 Generally speaking if the Judge sees reason
for substituting a fixation of his own to the fixation made by the
pursuer, the sum fixt upon by the Judge will be less than the
sum fixt upon by the pursuer: and in the ordinary state of
things, such reduction is the some such less such some lesser sum will
naturally by reason of the self preference interest in human
nature be the sum fixt upon by the Judge. But what may
happen is that in addition to the grounds for increase which have presented
themselves to the view of the party others may shall/will have presented themselves
to the more experienced eye of the Judge: if so it be in so far as they will
be his duty is the case he will present them to the view of the party person
giving him at the same time the liberty of substituting the
same increased sum thence resulting to the sum originally
fixt upon as the sum demanded
