Art. 9. In both cases, it will rest with the Judge
[on upon hearing the several requests of the parties and the grounds and reasons alledged
by them respectively in support of such these requests] to determine
what if any securities collateral security shall be
afforded by the party in favour of whom the conditional or definitive decree is
pronounced, in the event of the conditions not being fulfilled, or being
disfulfilled, as the case may be

On this occasion he will
elicit evidence and hear
both parties, as to the reasons for security
demanding

Art. 10 For this purpose he will receive elicit in the way
of evidence and hear in the way of argumentation what the party
requiring demanding such collateral security has to alledge in
support of such his demand: and what, if any thing, the party
opposing the demand has to alledgein opposition to it.
