(1 §. 5 Forthcomingness

§. 5. Of forthcomingness to wit for the purpose of execution

Art. 1. By forthcomingness understand
appropriate forthcomingness: by appropriate forthcomingness, forthcomingness
for the purpose of execution and effect whether in the
immediate way or in either of the intermediate preparatory and instrumental ways where
mentioned.

Thus have have we forthcomingness to either any one of the three purposes
abovementioned — probation, communication and immediate and
ultimate execution: in so far as concurrence, on the part of
the will of him who to whose undue forthcomingness in whom operation requires to be performed is
not necessary, forthcomingness in the physical and literal
sense: in so far as such concurrence is necessary, forthcomingness
in the abovementioned virtual sense: and in this case sense
in so far as the operator by which the virtual forthcomingness is produced is
effective, compliance is produced and has place.

Art. To be appropriate and effective, forthcomingness
whatsoever be the purpose of it — whatsoever be the subject matter of
it must be so not only in respect of place but moreover
in respect of time. Here

Hence on the occasion in the case of forthcomingness for the purpose
of eventual f execution over the danger of irreparable damage
and with it the great difficulty: especially as in this case
what is liable to happen is that the damage may be has been produced
when in a case in which it was not needed: for that when the time for immediate
execution came the g necessary and requisite forthcomingness
would not have been creating.

Such as by the supposition the case as after in a silent one who would
all along have so is subjected to arrest on the score of debt.
