Ch. Means of execution

3 §. Forthcomingness

Art. First then as to classes description of persons.

1. First came persons at large in the character of eventual
victims of bodily injury in its several possible shapes. Of these shapes
a general view has already been given in §.2; purpose preservation preserving or rescuing
of him the party whose from injury the person whose forthcomingness in whose instance the
provision for forthcomingness is made the forthcomingness is made to have place.
2. M Mode of forthcomingness, locatedness in some situation in
which the p then protected person may be in a state of security against the evil apprehended.

2. Next came persons appearing in the character of applicants.
Purpose preserving from injury vexation and expence
persons whom at whose charge in the situation character
of defendants or otherwise the application is make: persons
at whose charge the service called for by the application,
will, if th rendered performed be granted and performed. Mode
of forthcomingness, of all means by which a sufficient security
may be afforded to eventual defendants and forced witnesses
against undue at against vexation unnecessary and thence unjust either
in toto or in degree — of all those several sufficient modes
whatsoever shall upon enquiry be decreed to be regarded as
promising to be to the applicant in question least vexatious.

3. Next came person counterparties of the applicant in the character of counterparties
with the applicant
who though conjoined with him by in respect
of interest have not accompanied him in his application to the Seat of judicature.
Purposes, 1. joining with him in affording as above security
to defendants and forced witnesses against injustice; 2. affording
to him security for their bearing along with him their parts in that
vexation and expence attendant that may eventually be attend
the operation of claiming those services in the benefit of which
they so far as the claim succeeds they will receive have a share.
Mode, obtaining their personal attendance at the seat of judicature
for the purpose of their joint responsibility as above: their
attendance, or if without preponderant evil it can not have place
some security, in some other shape such security as shall be decreed
sufficient.
