3. Occasions and modes fit

III. On what occasion in what modes shapes forthcomingness may
with most advantage be made to have place: to wit to the
several purposes of probation eventual execution, probation and communication: and in each case instance with least damage.

Where it In so far as the sole purpose in view
in the production of forthcomingness the sole purpose in view
is the production of compliance on the part of him whose
forthcomingness is a question of in d relation to where the
desire that he be forthcoming, the question what it could be said respecting forthcomingness
may be changed transferred to into the a question respecting compliance.
The individual being supposed to be as to the purpose
of compliance forthcoming what is the most effectual efficacious course, and
at the same time the aptest in other respects that can be
taken for [the] securing of compliance.

The problem then here is — how at the commencement of
a suit in case of apprehended reluctance and non compliance
at the end of the suit how to obtain adequate probability
and assurance of compliance at the end of the suit? Compliance
in so far as at the end time in question of the suit may be found
necessary to the giving execution and effect to the decrees
which they being by on the part the applicant prayed in the part hands of
the Judge, it he may eventually see it right to issue?

In other words what at the former point of time nor
the obtainable, and of those obtainable what the most apt and thence desirable
pledges for the individuals on the present occasion the defendants
compliance with such decrees as it is at the contemplation
of the Judge to issue?
