Antagonizing considerations

Art. On this occasion the antagonizing
considerations quantitaties/objects which in the quality of elements
of belonging to the calculation in the character of elementary
quantities of in the calculation present a demand for
consideration may be thus stated —

1 Importance of effective
service demanded by
Pursuer

1. The importance of the service — of the effective
service, demanded by the pursuer at the charge of
the Defendant. This will vary from that of the smallest
sum of money which can be the object of demand
to that of the severest suffering to which the law has exposed
men for the hope of keeping extended the severest evil
t which man is exposed to suffer from human delinquency.
[In this element was may accordingly be seen included
two others, namely the magnitude of the punishment
and the magnitude of the crime.]

2 Magnitude of vexation
required to be imposed
on Defendant

2. The magnitude of the vexation to which for
the purpose of preventing the defendant from subtracting withdrawing
himself from under should he be so inclined, from the obligation burthen
of simple from escaping from under the burthen it may
be necessary to subject him, while the proof of his
being bound to render the service remains as yet uncompleat

3 Magnitude of inducement
to Pursuer to subject
Defendant to the necessary
vexation

The net magnitude of the inducement by which a
person in the circumstance of the pursuer may be led to
bear his part in subjecting the defendant to such precautionary
vexation in a the case in which it is under
under, whether it be that the service demanded of him at his hand
is not due, or that, the for preventing him from eluding it precaution so burthensome as that which is proposed is
mindless.
