1825. March 2
Procedure Code

IV
Ch.

(9) (5) (1) §. Countersecurity
practice

25
Existing system
such embarassments
avoided by giving
uncontrouled power
of pursuit to those
who can pay.

Such as have been seen are the difficulties
and embarassments which encompass the mind of the legislators
whose operations are governed by a real regard
for the ends of justice.

By English practice finds no such English practice knows of no such embarassment
By English judges, who in relation to the matter the part
of the field as in most other of the field of procedure in question have saved the supreme authority the labour
of legislation no such embarassment has been felt. Acting
with uncontrouled power in pursuit of its own ends here
as elsewhere the fraternity have been sitting upon velvet

So being Where and when as to those ends no neither see countersecurity seemed necessary
no countersecurity would they give. Any By any Still less then in any
person almost any other might for any thing or nothing on payment they of fees to the Judge and
to the price at which liberty was sold be cast into prison

26
Oath its insufficiency
as a security

When at last by the oppression and depredation thus committed
the uneasiness was felt to such an amount as to find its
way to the ears of a lawyer-led self stiled most self seated representative
of the people, a countersecurity such as it was established
and that security consisted in an Oath: an oath
the rotten provider of past yet sits penance for a so large a
portion of the introduced into the body politic by the
hands of lawyers, the economy if called on oath no matter by
whom any more than under what circumstances nor to
what end performed joined in with the word ready self/well paid one and
hands of the priests of the temple of chicane,

Of this nostrum the necessitating to set good purpose in whatever
form it has ever been administered will has come to be shewn elsewhere. What belongs to the present occasion is the observation — that in this
medium consists the
whole of the counter security
afforded on an occasion
for which the word of
an effectual counter security
has be is so urgent as it
has been seen to be.
