III Remedies
Ch Compensation

(1 § Degree of influence

In imposition of compensation any
distinction will be made of the number of the
in which it is : whether by inspection
or proof rendered

In a first instance, by
inspection
As in nature of the defendant
proof will be taken

§ Degrees in the scale of affluence here measured for the purpose
of compensation and punishment

money's worth possessed
inverse to burthen

Art. Of a man's persons place in the scale
of affluence the attitude will be as the amount of his pecuniary and money
quasi pecuniary means and money's worth directly, on the amount of his pecuniary
burthen and quasi-pecuniary burthen, inversely

No calculation on
means without amount
of burthen

Accordingly no assessment ought to be will be under
prescribed in the consideration in determination of his means exclusively:
even without taking into the account the amount of his
burthen, as above.

Difference between
income from capital
& other income

In the account of means or say assets due regard
will be paid to the difference between income derived otherwise
than from capital, and income derived from capital.

In account of burthen
expence of maintenance
1 of wife
2 of children
3 of helpless parents

To the account of burthen will be comprized the
expence of maintenance to afforded by the party to such dependants as belong
to him, deduction made of such earnings if any, as they are in
the habit of making. Of such dependants exemptions as following
1. In case of a married man, his wife.
2. His children such of them as are under age, and unemancipated
3. Any helpless Grandparent or other Progenitor or male or female
with whose maintenance he is obligatorily or habitually charged.
