When through the instrumentality of an English judicature
depredation and oppression are committed, costs factitious cost are in
most cases the capital instrument. No complaint so frivilus
but that with the help of this instrument, the ruin
of any one of a vast majority of the whole population
may by to a certainty be accomplished: and to every
one who will make this use of it a and that
an ample reward is certainly held out

defamation proceedings
as to costs under
natural procedure

By some trifling improbable cost in to his reputation of by testor
a correspondently trifling injury wrong is bestowed by Sales
Under Natural Procedure at the first and only interview
of the parties before the Judge, the matter would

manner at the usual expence, and the compensation being
proved — the foolishness of it at the same time made manifest,
the Judge informs the Jury that they are bound to find
the Defendant guilty but that the damages are at their
optics, and the sum appointed to be paid on that score may
be as small as they please.
