True, party has no
more power than substitute
to secure or
discover relevant
evidence.
But for obtaining from
Judge such evidence as
the case affords, better is
his chance then that
if one by whom the notice
of it is as comes at
second hand
subject to principals
omission or misrepresentation,
unintentional
or intentional in principal
and misconception
or m mis recollection
or misconception
or substitution, as above.
Incident to this same case are other evils. But, in
the case where the instead of a gratuitous substitute is a mercenary Assistant
these will recei so enormous is the encrease which these
evils, receive will be seen to receive even when taken separately, much more
when taken in the aggregate, that the consideration of them
under the present hand, may well be spared.
