Art
Art. An essential security for appropriate
aptitude on the part of the Judge as well as all other public functionaries
is the light of publicity kept directed up all judicial
operations with the in all cases except the comparatively small
numbers which an adequate by reason of this or that special
cause an adequate demand for temporary privacy or say security
has place.

Of this publicity an essential means is liberty to all
persons without exception to take notes of any thing that passes
in the Judicial Chamber, and in the report therein proceed to
give whatsoever degree and mode and degree of publicity
the parties in question is willing and able to give to it.

Of the instruction benefits thus derived the utility will depend
upon and be in proportion to the clearness, correctness and
comprehensiveness as also the of the maker
to which publicity is so given. The end and purpose of it will
be counteracted by every lot mass of surplusage that is to say of
matter howsoever in other respects incurious.

But it will be counteracted in one crucial degree
and evil opposition to the needs of justice produced, if in the account
so published any measure be given to any matter the effect
or tendency of which is to bring down ridicule upon an injured
individual by whom at the hands of the Judge redress of the wrong remedy and relief from the burthen of the wrong
is sought in so much that what the injured party obtains in the
character of Justice professed seat and source of justice is instead of or is at best why with relief
from wrong the so suffering produced by wrong, in addition to and aggregate of it.
