without leave from any Judge, the power of dragging
any other person whatsoever into a contest this expensive
And vexatious was conferred on every individual, without
exception

Thus far As yet indeed there is nothing for the profession.
But for the exercise of this power a written instrument
was made necessary — a citation. Of the form
necessary to be given to this instrument, a description
is given, but it is a description and nothing more: not
a blank form, in which as may points as may be are
particularized, such as those, which in no inconsiderable
number may be seen in English practice. When drawn
up with the benefit of these directions, should the
instrument in any particular, have the misfortune of
falling short, of the idea of perfection framed in the
mind of the Judge, the expence natural and factitious
together of penning the instrument & presenting
it to the sense of the defendant, would be the only
result to the applicant: while the defendant on his
part would likewise be plagued with the expence &
trouble of receiving the appalling instrument and making
his return to it.
