Place a Cojudicatory
transmission of Record

Art. If for the examin purpose of examination
to be performed on an witness or on a party in
the other either side the originating Judicatory Judge refers transfers the matter
to a Cojudicatory, he will transmitt to the Post originative Cojudicatory
for the information of the Judge and all parties interposed therefore
to the Cojudicatory an exemplar of the Record of
such all proceedings in the suit down to that time.

So of parties address

Art. So likewise He will at the same time transmitt
to the Judge a letter informing him of the address of all
parties who have appeared attended in person or by proxy as
parties at his judicatory, for the purpose of their
being accersed to the Cojudicatory as occasion may
require.

So of his opinion as
to which judicatory
suit to be prosecuted

Art. At the same time he will give his
opinion on as to the question at which of the two judicatories
the suit may in the manner most conducive to
the end of justice, further proceeded upon and finally
determined.

In case of disagreement
originating Judge
may retain the suit

Art. In case of disagreement the Judge of
the original Judicatory may upon his responsibility
persevere in retaining cognizance of the suit untill
the its termination thereof.

In this case the party
may appeal

Art. In this case a party whose desire
it is that the examination be taken in the Co Post originative judicatory may
upon his responsibility as to costs appeal as to this point to the Appellate Judicatory to wit
to that Appellate Judicatory within the territory of which the
territory of the originating Judicatory is situated. But Yet
notwithstanding such Appeal the Judge of the Originating Judicatory
may
may persevere in proceeding,
if on a determinate
account mentioned
by him such
perseverance be necessary to the prevention of irreparable damage: as to which see Ch. §.
