Case II. Suit incuplative: whether it be or be not also
criminate: incriminative say in the first case simply inculpative, in the other
case criminative. In both cases the character of the execution if and in so far as
it is in favour of the pursuers side is compulsory: compelling to
wit on the defendants side: for such in this case it is, whatsoever
be the nature of the remedy or remedies applied by it
