how can he avoid confounding the opening statements
of the Counsel with the evidence? How can a Jury
in a Civil Case, separate the evidence from the
representations given of it by Counsel, and perhaps
the partial account given by the Judge in his
charge? He that believes in the doctrine of prejudging,
without a fee or an intelligible motive
to help him, is fit for believing in witchcraft.
But his Lordship triumphantly informed
the Learned Sergeant, that if he thought otherwise
than himself respecting the benefit of such publications,
he should apply to the Legislature to alter
the Law — that was a home thrust. Apply to a Legislature
of which one House is exclusively composed
of Magistrates who dread nothing so much as
any inroads on their discretionary powers, and
wish to commit ad libitum. Call on the Legislature!
Goad.
Who in the Legislature dares at present, to
say a word about any Magisterial abuses? It would
be about as wise to call on the Stock Exchange
to put an end to jobbing. When Mr. Denamn
brought the affair of Canfer and Mr. Kewick before
the House, Mr Tierney made an excellent speech,
but all the Lawyers were silent. No, we hope for
nothing from the Legislature. Our only hope is in
the tribunal of Juries, which are identified with the
people, and which will, some day or other, return to
reason.
