Justiatory hearing when conclusive.
§.1
Initiatory hearing
cases where conclusive.
Art. 1. The only cases in which a suit, a
purely non penal, penal and private public or penal and
purely public can receive its termination at the first
hearing are these
1 Applicant attending
and demand dismissed
1. Applicants in the character of suitors, one or more
if more all app attending attendant in this mitiatory hearing, and
the demand simply dismissed
2 Both sides attending
and demand dismissed
2. All Parties on both sides or sufficient proxies Pursuer or Pursuers defendant or defendants
also appearing attending, both or all of them together, and the demand
simply dismissed.
3 Both sides attending
and demand adopted
3. All Parties on both sides or sufficient proxies attending both or all of
them together, and the demand simply adopted the
correspondent decree issued and on the part of the defendants
side compliance universally promised and undertaken
for.
Where no contention
no suit thence no
termination of a suit
Art. 2. If instead of a demand contention the
object purpose of the applicant be simply informative no act being
begun no suit is there that can receive its termination.
