Art. 9 In case of your inability to attend, as
above, you will do well to send to the Judicatory a
Testament Letter of testimony a Letter testification declaring what you has
been written your knowledge or belief concerning touching the matter
in dispute [between the parties] since by this means that vile consequence of the disappointment
occasioned by your non attendance may natu
preponderantly be lessened.

II. Veracity securing warning.

Art. Remember that if in such Letter of testimony
there be any thing of falshood either wilful or through rashness,
you will be responsible for it in the same measure
as if uttered by word of mount in the presence of the Judge.

all such falshood you will as also against unintentional want of correctness
clearness or compleatness you will nevertheless remain
liable to be examined by word of mouth whensoever
the impediment to your attendance state has been removed.

N.B. As in every case where by reason of
distance the attendance of the witness or party within the requested time
is impossible, as in the case of a distant county, there
must be a promise must be made as per §. for
examination in the epistolary mode, if when any doubt has
place as to the attendance at the judicatory the party may will do well to
the Judge at the desire of the party in question
may settle with him an Epistolary Examination paper and
send it out to the same individual before or after the Attendance requiring Mandate.
