Probity of intent or uprightness of intention as
distinguished from want of intention is where
a person or although he do was intending although it was the party's intention to do the
act which he actually did, and to produce the
consequences which ensued, yet it was not his intention
to do it except in as far as it was lawful:
it was In as much as he thought it lawful
his intention was to do it: had he thought it
unlawful his intention it would not have been to do it.
