An offence may be said to be pardonable
in toto by the party injured when he is at liberty to choose
whether he will or will not to commence or at any
time to terminate a prosecution for it as he thinks
proper, and when if he does not forbears to commence it or
terminates it, no other person can terminate commence
or continue it.
