Disposal of acquitted
criminals.
Let a man who after acquittal is held bound to his
good behaviour on suspicion, be at liberty to move
for a trial (upon the disclosure of fresh facts) to establish his innocence.
Let a man who after trial is suspected of a first-rate
offence upon evidence not absolutely conclusive
be consignable to confinement, non in
panarm ad in custodiam —
Accordingly let the Jurors be at liberty to
vote for compleat guilt, on which the Judge shall
pronounce compleat punishment; or violent suspicion
of guilt for which he shall into pronounce
safe-custody. And upon the disclosure of fresh
facts let either party be at liberty to apply
for a new trial.
Of those who are tried 2/3 acquitted
Of those who are acquitted 499/500 guilty of that
very offence
Of those who are acquitted 999/1000 guilty of that
or some other of the like nature.
Of those who are examined 500/1000 discharged though
guilty for want of full & legal evidence
Of those who are known to be guilty by the
Thief-takers) 900/1000 not taken up knowing there is no legal evidence.
Observe on this occasion that 19/20 of criminals are
Thieves.
