Limitation of Actions

In case of limitation of time, provide for the contingency
of an abatement of the suit, in nonsuch
or verdict for want of evidence's appearing &c Or an
Appeal.

Provide also for neglect of Attorney's &c. In such
case let the Action be commenced notwithstanding, & Act
if any inconvenience arise to the Deft let the Pltf's Attorney
&c be answerable to the Deft for it.

interest

Wherever any delay has been occasioned by
the application of the Deft let the time be noted
and if the Deft prevail and get compensation
money be awarded him let the interest upon such
compensation money be allowed him for that home.

Let such interest be of course one third more than
the ordinary highest rate of ordinary interest allowed of in this
Country. Let this be called expediting interest. But
let the Judge may upon particular grounds reduce it as low
as to ordinary legal interest

Penal interest

Where the delay has been affected, let the interest
be of course double the common legal interest. Let this be called
Penal interest. But the Judge may upon special
grounds reduce it so low as down to ordinary
legal interest.

Compound interest

[In case of affected delay let the delayer] Where penal interest is given let the party
be subjected also to compound interest: then pre interest
being added to the principal every quarter.

Interest upon an
Appeal

Upon an Appeal let penal interest be given
of course; form the time of the Judgment unless the Judge certify that there was probable
cause for the Appeal.

Let Interest also be given upon the costs of the Appeal:
