1825 April 23 Sheriffs Procedure Code Scotch Small Debt Court Bill Marginals
1.
Sheriff may hear and
determine Civil causes
for sums render a
certain amount, in
a summarily manner.
2.
Pursuers to proceed
upon petition, in such
causes, according to form
set forth in Schedule
(A)
3.
Copy of such petition,
with citation annexed,
to be delivered by the Sheriff's
officer to Defender.
4.
Officer of Court to lodge
written execution in
Clerk's hands, when required by pursuer
or defender, to cite persons
as witnesses.
5.
Penalty for not appearing
after having been
cited by such officer.
6.
Sheriff to hear parties
vivâ voce, and examine
witnesses upon
oath; no solicitor to
plead for parties, unless
with leave of Court
first obtained.

7.
Defender failing to
appear, shall be held
as confessing the debt.
8.
Where decree pronounced
in absence of Defender,
he may obtain warrant
to list execution
till next Court day.
9.
Book of causes to be kept.
10.
Sums found due, may
be paid by instalments.
11.
No decree subject to
stay of execution, except
only in cases of action
of reduction before
Court of Session, on the
ground of malice on
the part of the Sheriff.
12.
Fees to be taken.
13.
Members of College of
Justice not exempt
under this Act.
14.
Clause (A)
Sheriff to ordain Expenses
to be taxed.
15.
Construction of terms
used in his and other
Acts.
