Justiciability, what
Ch. of Justiciability
§§.1
By justiciability, I mean understand the state of him, in respect whose
of whom instance the adverse party possesses the means of causing him
[to submitt to the decision of the Judge] to be put into such
condition, whatsoever it may be as the Judge, shall deem it is just proper/fit to put him
into, in consequence of conformity to the provision made in that behalf by
the law.

This state will consequently vary — and consequently the notion of
justiciability, and of the steps proper and necessary for the securing
it, with the nature of the cause: with the class of it belongs to
in the grand division of causes into penal and non-penal — and
with the nature of the demand, in according to the each genus and species
in that class of causes.
It will moreover vary as will be seen according to the circumstances of the individuals
concerned.
