§§.2 Rules or Articles
1. Except as excepted, let the burthen of costs be
in all causes cases and all cases, thrown upon the party in whose that one of the parties who is in favour
the wrong the division is pronounced: that is to say not only the obligation
not only of continuing to bear without the reimbursement the burthen of
such expence as he himself has disbursed or incurred on the
occasion of the suit, but who the of reimbursing to the adverse party
the amount of such expenses as he the adverse party has disbursed
or incurred.
2. Causes of exception to this rule may be referred to the following
heads, viz:
1. The number of the species of cause, in respect of the a doubt that
may be entertained to which of the two sides of the cause the decision has
been unfavourable.
2. The stage of the cause: whether it be the stage of immediate procedure,
or of procedure in the way after of removal or appeal
3. The non-necessity of the expense disbursed or incurred.
4. The pecuniary insufficiency absolute and or comparative of the party on whom
the burthen of reimbursement costs would fall according to the general
rule.
