The arrangements proper to be taken in regard to Removal Appeal
will be liable to be modified by the following considerations, viz:
1. The nature of the suit whether penal or non-penal: and
of penal whether purely penal or mixt, with the burthen of satisfaction, and in
each case, whether the punishment be of the highest or any inferior degree.
2. The intervention or non-intervention of a set of ephemera
Judges, such as an English Jury, in the Court above.
3. The nature of the question the decision on which is the subject of
the appeal: viz: whether it be the question of law, the question of
fact, or both together.
4. The topographical distance between the Court below and the Court above.
