In case of mala fides (it may be said) the Judge below ought
to be punished: nor ought the punishment to be less than what consists
in removal from the office, the powers of which have been
thus abused. True: but a degree of evidence much less than
what will would be necessary for punishment, may be sufficient to warrant
and demand the employment of the purely remedial measures above
suggested.
