Constitutional Procedure Code or Const. Code Judiciary

Ch. General View
S. Ends of Judicature

5
Procedure natural
& technical

Of this latter formula one use will be seen when the
system of procedure here proposed under the name of
the natural system comes to be contraposed and compared
and contrasted with these others for the designation of which, it will be seen
with what propriety, the deferential denomination of technical is
here employed.

6
Substa End of substantive
branch assumed to be the
greatest happiness to
the greatest number

When the giving execution and effect to the substantive
branch is spoken of as the right and proper as
well as mere object of this adjective branch, here in question an assumption
which is implied is that the substantive branch has
for the its end in view — for the object of the accomplishment
of which it is directed — the greatest happiness of the greatest
number — the maximization of human happiness
For in so far as for its object the system of substantive
law has for its object an object a result approach in any part
from the maxim of bringing happiness, this instrumentary
part will it is manifest be in proportion to
its relative persistence, contributing to that evil effect
and in so far : and conversely, in so far as
the adjective branch fails of being subservient to the production
of any sinister effect which the substantive branch
has a produce, lends or endeavours or lends, the effect of it may be [indeed will be]
beneficial upon the whole — endures to the maximization
of the net sum of happiness. Nor will the observation
be without its application in practice to actual

Thus it is that for the explanation and maximization
of the principle spirit by which the here proposed matter of System
of Judiciary Establishment has been determined, it has secures
become necessary to bring to view some of the first law
of the system of Judicial procedure connected with it: and
moreover for the better explanation of this, the correspondent
first of the opposite system the
as exhibited in the all the normal system any where as yet established
