Any instrument argument accepted employed for the purpose of producing this
opinion is termed in evidence a piece or say article of evidence,
and in the aggregate, any assemblage of such instruments
is termed evidence — is say a body of evidence.

Next of kin to the signification of the word evidence
is the signification of the word proof.

Evidence & proof distinction

The phrase of which the word proof makes a part
is different from the phrase of which the word evidence makes
a part. We say to bring evidence — to address evidence
we do not say to make evidence

We say to bring proof to address proof and to
make proof So to make evidence would seem to be as much
as to say — he committed a forgery — he forged a note
a piece or some article of evidence.
