9. The Defendant having a fixed abode, but frequently
absent from it for indeterminate length of time,
and during his absence, the habitation empty, or
not containing any person but such as by inability
to read, by know nonage or other cause, are incapacitated
either from receiving the missive or
from making any assuredly effectual communication
of it to the Defendant within the requisite
time.
