Epistolary correspondence
adapted at this instance
of applications

Art. Though not in general so well adapted
to the purpose of securing testament application as the oral
mode, the epistolary may at the instance or with the
consent of the applicant of the party who applies for it
be employed instead. The ground on which it may be
substituted are these

1. The matters of fact in question simple: 2. to
an inadequate appropriate and sufficient answer no extraordinary intellectual
aptitude necessary. 3 on the part of the intended
examiner no reluctance suspected as to the use of notification, nor
as to the correctness or completeness on the part of the matter
testified.

3 Expense too great compared

2. The expense unavoidable expense of the examiners
migration to the original judicature either greater than the advantage expected
from the testimony, or greater than the pecuniary condition
of the applicant is able to support.

Code of the occasion

Art. When the examination is then endeavoured

with the interrogations being settled as per §§.
Art. will be written upon a paper in which is contained
the Code of the occasion, and being duly affected
at the Judicatory will be sent transmitted to the foreign country either
by the ordinary post or by any other such conveyance
as may be found obtainable and deemed preferable,

Examinable abroad

It may be addressed either to the proposed examiners
or for better assurance to some person of the applicants
choice by what in confidence of its being by him
delivered to the proposed examiner.
