(2 §. Epistolary probation
when employable
14
Cause of insufficiency
adverseness maximised
Against the use of this mode the On the part of the result
of this mode of collection one cause of insufficiency is altogether obvious —
to wit the certainty that in relation to the pursuers
wishes and to the interest of justice where his demand is well-grounded,
adverseness will in this instance case be maximised.
15
But in this case trustworthiness
is maximised
But if notwithstanding the adverseness the power of the obstacle/temptation to the temptation is overturned
and the evidence sufficiently favourable to the pursuers demand
the verity of the evidence is more unquestionable as
well as manifest in this case coming from this party than it could possibly
be if coming from the most trustworthy extraneous witness
16
Even under existing
system trustworthiness
of self accusing adverse testimony
recognized
Even under the current system the superior trustworthiness
of testimony in this case when employed against the testifier is universally
recognized, although according to those systems when
once collected in this mode it can not generally be
extracted from the same individual in relation to the same part
in the oral mode. But under the here proposed system it
is allowed in all cases: and being so allowed how prodigious vast
the thus made to the security for veracity and
verity is altogether manifest.
