Expenses adequate or
inadequate
Art. An excuse may be adequate or more or
less ad inadequate.

Adequate where alleged grounds
are considered as indicative
of physical
impossibility of compliance
It is [stiled] inadequate where the effect given to it
when the effect of it circumstance indicated by it is considered as being such as to render
pursuance compliance physically impossible.

Inadequate where
indicative not of impossibility
but merely
inconvenience
It is stiled inadequate when the circumstances
indicated by it is regarded as being such as to render
pursuance compliance not physically impossible, but only
inconvenient attended with inconvenience: which inconvenience
may be regarded as preponderant or as not
preponderant

If excusor produced
the impossibility for the
purpose of the excuse
the allegation not an
excuse but an aggravation
If the cause of the i alleged impossibility the difficulty
or the inconvenience have been for the purpose of affording
the excuse has been brought about by the excusor, the
allegation so far from being admitted as an excuse for
the non performance non fulfilment of the obligation in question, is an
aggravation of the offence committed by the breach of it.
