Art. Decease, how recent so ever, of a relative
how nearly connected so ever, ought should not in any case
to be accepted as an exculpatory excuse for non-attendance

4. Nor of a testator whose testamentary executor the individual

Reasons

1. Complication [ and addition to the aggregate bulk of the rule of action]
that would be the necessary result of the undertaking
to draw an appropriate and correct line between the cases
in which such relationship shall, and those in which it
shall not, be received as an excuse.

2. Insufficiency of any such line in respect of its intended
purpose, The Sole purpose avoiding to aggravate affliction
