For securing veracity
employment of the oath
For securing the veracity of the responses exacted to these
interrogators the employment application is made of the ceremony
called an oath to the case of these voluntary Bonds, as in the cases
of witnesses. For to the accuracy of the details of the secure exhibition
great solicitude is asserted the utmost importance is attached the probability
of veracity is pretended to depend upon these nothingnesses
and not upon the eventual punishment ordained by law: pretended
by all these Judges to no one of whom can it ever have
been unknown that whenever the legal punishment
does not attract the formalities are altogether devoid of
effoc efficacy. The This exhibition having been made by
the wilful falshood uttered by the actor in the
farce, the Insurer as he is called is stiled perjury, and the suffer of the
under it is for the profanation of the ceremony not for
the falshood uttered and the mischief thereby produced
that the punishment if any is inflicted. Of the mass of perjury
the quantity f produced, might an appropriate
enquiry be a subject matter of calculation: be it what
it may, these same Judges may without fear of injury
be set down in the last catalogue of suborners in respect
of it: for one of in this useless form — this shown to be
and useless may be some one of the services out of which this
profit is reaped: the more greater the mass of perjury the
greater the mas of profit.
