Ease to legislator &
Judge produced by this
indiscriminating
atrocity

[ By an atrocity that indiscriminating not inconsiderable
in one respect is the degree of simplicity produced.] True it is
that by this indiscriminting atrocity not small is the relief
afforded to the legislator and the Judge. Excluded from this
brush is all such cases as this which is here taken to maximum
or each individual occasion the evil produced in the
shape of vexation and expense by the employment application given to
the legal remedy, to the means employed for the securing of
attendance in the first place and as well as ultimately the giving execution
and effect to the law

eminently conducive
to ends of judicial
corruption & oppression
totally inadequate to
ends of justice

Thus eminently conducive and adequate to the ends and purpose
to which it was really directed — the purposes of judicial
corruption and oppression not less remarkably and undeniably
is the system inadequate to the main purposes for
which it was all along been pretended to be framed
but for which in no instance it now was framed — the giving
effect to just demand.

In every instance
prehension of body
only not to subject matter
of property

In every instance, at this stage of the suit it is to the body alone of the Defendant
that the power of prehension is allowed to attach — not
to moveable subjects of property — not to immoveable
subjects of property — not to much less rightly the incorporal
subject of property, called, as above, rights. But as
means of eventual compensation what is the thing in the
first place to be looked to, these exercises of authority,
being in a direct an immediate and not mostly one unimmediate way
conducive subservient are in proportion more apposite with reference to the direct end
of justice: at the same time, that in many instances, upon
due and appropriate enquiry they would be found less burthensome
to the defendant, and in that way more effectuable
subservient to the collateral ends of justice.
