Art. On the procurement of evidence by the compulsory
mode justice will require that for and to the proposed witness as so far as the
pecuniary circumstances of [him the requirer who by who be having need of
it, it is required] admitt compensation as an indemnity
for the expense and vexation should be provided
and if conceivably practicable transmitted In this case
will be taken by the Judge that sum that is sufficient for
this purpose be not allowed. True it is that in a case between
individual and individual number or a suit inculpative
or not and not criminative, eviden the
of the evidence in favour of the pursuer's side might not, to be
read naturally will not be, as in the case when a purely
public or privat public-private case made a condition
to the delivery of the money. But in so far as by so much as it exceeds
the ad amount of a strictly adequate compensation, by so
much it will naturally have a tendency to
the favour of the proposed witness, and to engage his affections sympathies
on that side: and the stronger that affection the greater will
be the danger that in favour of that side his evidence
will change from the line of truth and justice
