As to its whole and the principal part of its contents
The Procedure Code at present acted upon in England
has had as to the for its authors in an immediate position and action was
the Great Judges a set of men who to save words may be
once for all be stiled the Great Judges, or for still greater conciseness frugality the Judges
in an immediately and p as it were passive negative and passive
way the Parliament composed of Kings Lords and Commons
for whatsoever good or evil has at any time been done by
a Judge or Judges Parliament has at all times been done under
the eyes of Parliament, and subject to the power of Parliament.
Having had the same Judges for all its authors, the
Code in question has had from first to last throughout the whole time
of it the conjoint interest of these its authors. This interest is indirect
has at all times been and still continues to be in a state
of utmost diametrical throughout the greatest part of the field of legislation
and judicature in a state of diametrical opposition
to the interest of the greatest number: this being if this and in so far as this is the case, it
as it is a particular so may it with indisputable propriety
be termed a sinister interest.
In the framing of the existing Code the authors have accordingly
been at all times acting under the dominance of a sinister
interest: the work has been the product and fruit of that same
sinister interest.
