In every Sense, the Procedure Code has for its sole
professed object, or end in view and in fact for the most so great part for its actual
object or end in view the maximization of the execution
and effect given to the Substantive Code, to which it is an
appendage. In To this Substantive Code is belongs contained whatsoever
portion of law is not contained in the Procedure Code
The Substantive Code for the the given execution and effect of which
in so far as necessary the present Procedure Code has for its main object being a Code which
has for its sole end in view and object the maximization of
the felicity of the whatever State, if any, it be by which it may come
to be adopted the pro here proposed Procedure Code has for
its main end the giving execution and effect throughout to that
same Substantive Code
But to no Procedure Code, nor consequently to
any Substantive Code can its execution and effect be so
much as and commenced to be given but
a nature portion of evil more or less considerable in the shape
of vexation, expense and delay, one two, or all of them will
thereby have been produced. These effects all of them evil may
be stiled Mutual effects, to minimize this collateral evil
in all its shapes will on each occasion be a the collateral end
and evidence of the same proposed Procedure Code
The present proposed Code is throughout the whole extent
of it a really existing proposed Code. It wants nothing
but the sanction of authority to be a really existing Code.
Not that even by that instrument it could be constituted a
compleat [in all instances] Code. For the political state to which
it applies not being given compleatness could not be given to the
Substantive Code of which it is the a proposed appendage. Nor yet has to
that same S proposed Substantive Code has any determinate form of
words been throughout given. But by this deficiency no effective bar has been opposed
to the retention of such parts by which the form of the next will
with little difficulty or
danger of aberration be
determined
