1825. March 20
Procedure Code

2
Ch. Prospects as to reform
2 §. 1

This most feasible or say this least unfeasible
and improbable shape is that which it would assume
by clearing the field of judicature justice of the superfluous office
[with their fees.] L In this case let me see who in part
of money and ease would be gainers, who, in one or other
or both, the losers

The gainers would be as follows

1. Professional men at large: in all the branches of the professions
and without exception in regard to individuals those
excepted who had in view the patronage in relation to the
Offices thus suppressed.

The interest here is obvious and unquestionable
Proportioned to the amount of the mass of emolument reaped
by these useless and mischievous functionaries would be the diminution effected on
the aggregate expense of litigation strike off this expense
and of those who are at present unable to purchase tickets in the
lottery of procedure legislation a proportionable number would
by this reform be let in, and because aggregate to the numbered among
numbers the purchasers of the instruments of the professionalists.

2. To these might be expected to be added, if this supposing that
which comes before what presents itself as being is at once the most humane, prudential,
and probable course, namely something more than compleatly adequate
indemnity compensation given or rather something more, the eliminated
functionaries themselves

3. Among individuals at large, all such person as
having before their eyes either the experience, or a prospect more or less distinct of
the obligation of being engaged in litigation, either on the pusuers
or on the defendants side, would be beholding as arising from the saving
a greater advantage to a greater amount than any thing was in
expectation of from a participation in any shape from in the abuse.
