Add how Counsel and Attorneys are all to get
so much more than Judges
Having thus in their own hands the power of existing
payment for themselves, and fixing the amount of it according to their
own pleasure, a person who looks over a table of judicial
fees in question that may be apt to present itself is — how came
they to be no higher than they were? compared with the price
paid for other services compared with the price of the labour of those professional
men whose operations procured go hand in hand with their own they will
be apt to naturally present the idea of moderating
The answer is it was by the nature of the case
and the moderation of the desire, that the price was first this low.
The amount of aggregate price obtained by them for the aggregate amount of the
services depended upon the numbers of their contributions: suppose
the price of each service raised, what they gained by the negation
of each payment, that and more might have been lost by a diminution in
the number of payments: as it is in so high in the price put upon the species of services that
by mere inability to pay the it more people at least of the community
are obliged to go without it.
To settle the amount of individual payments in each
suit or to give maximization to the aggregate, required the utmost
stretch of evil and judicious calculation: the golden increase
the strength of the appetite could would by its strength be continually principled prompted to overpass
accordingly even in the present time in the case of the First Court
of Exchequer learned rapacity had been found there to frustrate shroud its own
purpose.
