§ 1. Proper ends of judicature

Ends direct and collateral
Art. 1. The ends By a first division the ends the end
of justice proper ends of judicature may be ranged under two heads separated into two branches — the direct
and the collateral.

Direct Ends positive &
negative
Art. 2. By a second division the direct ends
of justice may again be distinguished into two branches
— the positive and the negative.

Positive direct ends what

Art. 3. By the positive direct proper end of justice understand
the rendering to the demandant the service demanded
by him, if so it be that it is due to him according to
law

Negative direct ends what

Art. 4. By the negative proper end of justice understand
the refusing to the demandant the services demanded
by him, if so it be that it is not due to him according
to law

As to procedure both
ends regarded as one

Art. 5. Considered in a certain point of view
these two ends may be regarded as one. This one will
be the giving execution and effect to the declared will
declared made known by the legislature touching the matter in dispute:
giving execution and effect to that portion which is in
question of the substantive branch of the law: that branch with relation to what the law of procedure
forms constitute the adjective.
