1826. Septm. 21. Procedure Code.

Though the intercourse between the judge
that is to say the three great common law judicatories,
with the sheriff has at present no rational cause,
it has however, like every other state of things its historical
cause, and in it's origin had even a rational
one. The sheriff is in law-Latin a vice comes. Deputy
in those days of the great man stiled in French from
Comes, Comte — great enough to be among the companions
of the King — in English from the Saxon,
Earl. So many of these Earls, so many counties
over these earls, the Monarch was Despot: under
kind, they subdespots: they every now and then confederating
with one another, and revolting against
him: he, for the sake of their forfeitures, every now
and then, by provocation a secret intrigue, encouraging
their revolts. No direct authority had the King,
within the several territories of these Earls. Still
less any such ever removable creatures of the Kings
as were called his judges. Nothing therefore within
the territory of an Earl could be done by any of the
judges through the medium of any immediate agent,
located and dislocable by them. But the Earls being
too great to carry on in their own persons any such
petty business naturally and soon fell into the habit
of devolving it, each of them, upon a deputy of his — the
viscount or sheriff: and though the principal, by a
mixture of pride, indolence and ignorance, was
kept from holding, in a subordinate character, any
direct and habitual intercourse with the Kind's unmilitary
Deputy, the judge, such was not the case
with the Earl's deputy: and thus it came, that in
this mode of communication, the inter-communicants
came to be and have even continued to be, the judges
of the several judicatories, & the Deputy of the Head of the
Country
