will for this purpose mete it out, and by an
indemnity at his charge given to the sheriff take
the responsibility of the measurement upon him
self: one consequence, is that unless the Defendant
is satisfied with the decision given against
him by his adversary, the same process is to be
carried on over again and so on toties quoties:
with this difference between the second case and
the case first, that in this second case the plaintiff
in the first being in possession, the part of
plaintiff will in this second case be to be acted
by the quondam defendant.

A volume would be filled, ere an
intelligible account would be given of the
squabbles continually carried on between this
attorney of the sheriff or the attorney or attornies
of the party or parties on the one side or the
other, or on both, carried on in all cases at
the expence of the parties, and to the profit of the
sheriff's attorney as well as the other attornies
and to a certain degree at the expence of his
master: always apparent the war, in most cases
probably real, but in not a few cases probably
the result of confederacy and collusion, and
thence but apparent: continually, so it happens,
that the sheriff contrives to get himself as the place
is ruled; and in proportion as the sheriff is ruled,
parties one or both, are delayed, vexed and pillaged.
